• Insurance Agency: Countach Insurance Agency operates as an independent intermediary between clients and licensed insurance companies in Kenya.
• Policyholder: A person or business entity that has purchased an insurance policy through Countach Insurance Agency.
• Insurance Provider: The licensed insurance company underwriting and providing the policy.
• Premium: The amount payable for insurance coverage.
• Claim: A request for compensation, submitted to the insurance provider based on policy coverage.

2. AGENCY ROLE & DISCLAIMER

• Countach Insurance Agency is not an insurance company. We facilitate the process of obtaining insurance policies from licensed insurers in Kenya.
• Insurance coverage, terms, and conditions are determined by the insurance provider, not by Countach Insurance Agency.
• We do not guarantee insurance approvals, policy claims, or pricing decisions made by insurance companies.

3. ELIGIBILITY & USER RESPONSIBILITIES

• You must be at least 18 years old to request an insurance policy.
• You agree to provide accurate and up-to-date personal, vehicle, or business information for quotes and applications.
• It is your responsibility to review the terms, coverage, and exclusions of any policy before purchasing.

4. INSURANCE PRODUCTS OFFERED

We assist clients in obtaining motor and non-motor insurance policies, including:

4.1 Motor Insurance

• Comprehensive & Third-Party Cover for private, commercial, and PSV vehicles.
• Required by Kenyan law under the Motor Vehicle Insurance Act.

4.2 Non-Motor Insurance

• Home, business, travel, health, life, and liability insurance.
• Coverage details depend on the insurance provider’s policy terms.

5. PREMIUM PAYMENTS & POLICY RENEWALS

• Premiums must be paid directly to the insurance provider or through Countach Insurance Agency as an authorized payment intermediary.
• We may assist with reminders for policy renewals, but it is your responsibility to ensure timely payments.
• Failure to pay premiums may result in policy cancellation by the insurance provider.

6. CLAIMS ASSISTANCE

• Motor Insurance Claims: Must be reported within 48 hours of an accident, along with a police abstract and supporting documents.
• Non-Motor Claims: Must follow the insurance provider’s claims process.

We assist clients in submitting claims but do not make final claim decisions.

Your use of our Services is subject to our Privacy Policy, which outlines how we collect, use, and protect your personal data.

8. PROHIBITED USES

You agree not to:

• Submit false or fraudulent information when requesting insurance.
• Use our Services for illegal activities or unauthorized data collection.
• Misrepresent our agency as an insurance company.

9. DISCLAIMERS & LIABILITY LIMITATIONS

• Countach Insurance Agency is an intermediary and not responsible for underwriting decisions, claim approvals, or policy coverage limits.
• Insurance policies are governed by the terms set by the insurance provider, and disputes must be directed to them.
• We are not liable for losses resulting from policy lapses, claim rejections, or misrepresentation of information by clients.

10. GOVERNING LAW & DISPUTE RESOLUTION

• These Terms are governed by the laws of Kenya, including the Insurance Act (CAP 487) and the Data Protection Act, 2019.
• Disputes shall first be resolved through negotiation and mediation, before escalating to arbitration or litigation.
